Terms & Conditions
Last Updated: October 2, 2026
1. Acceptance of Terms
By accessing, registering, or using the BrokerOS software-as-a-service platform ("Service"), operated by BrokerOS Technologies ("Company", "we", "us"), you ("User", "Customer", "Organization Owner") agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.
2. Scope of Service & Platform Limitations
BrokerOS provides software for real estate lead management, pipeline tracking, campaign webhook attribution, attendance logging, and deal ledger management.
BrokerOS is a software management tool, NOT a tax invoicing engine or real estate brokerage firm:
- BrokerOS logs deal invoice numbers and amounts entered by users, but does NOT generate or issue statutory GST tax invoices.
- Users are solely responsible for generating official tax invoices from their accounting software (e.g., Tally, Zoho) in compliance with Section 31 of the Central Goods and Services Tax (CGST) Act, 2017.
- Users are solely responsible for obtaining and maintaining valid Real Estate Regulatory Authority (RERA) Agent Registrations under Section 9 and 10 of RERA 2016.
3. Subscription, Renewal & Billing
BrokerOS operates on a per-seat subscription basis billed per 30-day billing cycle.
- Manual Renewal Only: Subscriptions do NOT auto-renew or auto-debit user credit/debit cards. Users must manually initiate renewal prior to subscription expiry to maintain active workspace access.
- Expiry & Suspension: Failure to renew prior to the end of a billing cycle will result in temporary workspace read-only locking.
- No Refunds: Subscription fees paid for active billing periods are non-refundable under any circumstances. Evaluation trials are provided to evaluate the software prior to payment.
4. Telemarketing & TRAI DND Compliance
Users utilizing the BrokerOS cold-call module or messaging features agree to strictly comply with Telecom Commercial Communications Customer Preference Regulations (TCCCPR 2018) enforced by the Telecom Regulatory Authority of India (TRAI):
- Users shall not make unsolicited telemarketing calls to numbers registered on the National Do Not Disturb (NDNC/DND) registry without explicit opt-in consent.
- Users are responsible for obtaining DLT (Distributed Ledger Technology) Entity & Template approvals from Indian telecom operators before conducting commercial messaging campaigns.
- BrokerOS disclaims all liability for telecom SIM disconnections, fines, or penalties resulting from user telemarketing violations.
5. Data Privacy & DPDPA 2023 Compliance
Both parties agree to comply with the Digital Personal Data Protection Act (DPDPA), 2023. BrokerOS processes data solely as a Data Processor on behalf of the Organization. Upon deletion of an organization workspace, all business leads, site visit notes, and project records associated with that organization are permanently purged from database servers via cascading deletion.
6. Limitation of Liability
To the maximum extent permitted by applicable law, BrokerOS Technologies shall not be liable for indirect, incidental, or consequential damages, loss of business revenue, lost real estate commission, or data loss arising out of or related to your use of the Service.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings or disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
